What's Changed?

We updated our website Privacy Policy to better match our HIPAA Notice of Privacy Practices, so it’s clearer how we protect your information, what we collect online, and how you can reach us with questions.

Welcome to Midtown Dental Group. Your privacy matters to us. This Website Privacy Policy explains how we collect, use, and share information when you visit or interact with our website, online forms, and related digital services (the “Service”).

This policy does not replace our HIPAA Notice of Privacy Practices (NPP), which explains how we may use and disclose Protected Health Information (PHI) in connection with providing dental care. See the “Health Information, HIPAA, and our Notice of Privacy Practices” section below.

We do not share or sell mobile opt-in data or consent to third parties for marketing or promotional purposes.

 

11) Children’s Privacy

Our practice provides care to individuals of all ages, including pediatric patients. For website interactions, we do not knowingly collect Personal Data from children under 13 through the Service except as necessary to respond to a parent/guardian inquiry or support care-related requests. 12) Health Information, HIPAA, and our Notice of Privacy Practices (NPP)

If you become a patient, information we collect or maintain in connection with providing dental care may be Protected Health Information (PHI) and is governed by HIPAA and other applicable privacy laws. Our HIPAA Notice of Privacy Practices (NPP) explains how we may use and disclose PHI, your rights, and our responsibilities.

Our NPP has been updated to reflect federally required changes related to additional confidentiality protections for certain Substance Use Disorder (SUD) treatment records under 42 CFR Part 2, with a compliance deadline of February 16, 2026.

Key points about SUD records (42 CFR Part 2):

  • Some SUD-related diagnosis, treatment, or referral records may be subject to special federal confidentiality protections.
  • In many situations, SUD records cannot be used or disclosed for treatment, payment, or health care operations without your written consent, except as permitted by law.
  • SUD records generally may not be used or disclosed against you in civil, criminal, administrative, or legislative proceedings without your written consent or a court order with notice to you.
  • When state or federal laws provide stronger privacy protections than HIPAA, we follow the stricter requirements.

Redisclosure warning: When health information is disclosed as permitted by law, the recipient may re-disclose it, and it may no longer be protected by HIPAA.

If we ever conduct fundraising communications using information that is protected by 42 CFR Part 2, we will provide a clear way to opt out of those fundraising communications.
